\u00a7 1 Contracting Parties and Scope of Application<\/b>\u00a0<\/b><\/p>

  1. The contracting party for the customer in orders through our online shop MyBeglaubigung.de (VAT ID: DE363149943), located at Pappelallee 32a, 10437 Berlin, and represented by the managing director Yigit Aslan.<\/li>
  2. The following business relationships in the version valid at the time of the order shall exclusively apply as the contractual basis between the contracting parties.<\/li><\/ol>

    \u00a7 2 Conclusion of Contract<\/b>\u00a0<\/b><\/p>

    \u00a0<\/div>
    1. MyBeglaubigung.de offers predefined translation packages for various types of documents (certificates, diplomas, etc.) to private customers through an online shop, including certification by sworn translators in Germany. Customers have the option to add translation packages to the shopping cart by selecting the type of document, uploading the documents to be translated, specifying the correct number of pages, and choosing the language combination. This also applies to several different translation packages, if desired. All translation packages added to the shopping cart, including the uploaded documents, the selected number of pages, and the language combination, can be changed or deleted at will before ordering.<\/li>
    2. The contract between the contracting parties is definitively concluded by checking the box to accept these General Terms and Conditions and by ordering and paying through the online shop of MyBeglaubigung.de. Subsequent changes to the order are excluded.<\/span><\/li>
    3. The prior selection of the correct document types, number of pages, and language combinations is the responsibility of the customer.<\/span><\/li>
    4. By placing the order, the customer expressly declares that MyBeglaubigung.de should begin executing the contract before the expiration of the statutory withdrawal period. Further information on the withdrawal period and the consequences of a withdrawal can be found in \u00a7 9 of this contract.<\/span><\/li>
    5. After the order has been placed, the customer receives an email with a summary of the ordered translation packages.<\/li><\/ol>

      \u00a7 3 Delivery and Delivery Time, Cancellation and Withdrawal<\/b><\/p>

      Delivery and Delivery Time<\/b>\u00a0<\/b><\/p>

      \u00a0<\/div>
      1. The delivery times specified by MyBeglaubigung.de before the order are estimated based on the type of document, language combination, and the specified number of pages. These serve as a guideline and are not to be understood as binding delivery times. Delivery times may be delayed due to holidays, translator illness, or other circumstances.<\/span><\/li>
      2. The estimated delivery times refer to digital delivery via email as a PDF file and do not apply to postal delivery. Postal delivery is sent promptly and free of charge with Deutsche Post AG on the day of digital delivery and usually arrives at the customer's address within 1-2 business days. MyBeglaubigung.de has no influence on the actual postal delivery time or any possible delays by Deutsche Post AG.<\/span><\/li>
      3. MyBeglaubigung.de delivers exclusively within Germany and to the address specified in the order. Subsequent changes to the delivery address are excluded.<\/span><\/li>
      4. If the customer negligently, intentionally, or accidentally provides an incorrect or erroneous delivery address, leading to an unsuccessful delivery and return by Deutsche Post AG, the customer bears the costs for a renewed postal shipment to the correct address.
        <\/span>
        Cancellation and Withdrawal<\/b><\/span><\/span>\u00a0<\/li>
      5. Cancellation of the order after the conclusion of the contract pursuant to \u00a7 2 paragraph 2 by the customer is only possible through the exercise of the right of withdrawal in accordance with \u00a7 9 of this contract. This also applies if the customer accidentally selected an incorrect language combination or uploaded an incorrect document.<\/span><\/li>
      6. MyBeglaubigung.de is entitled to cancel the order and withdraw from the contract,<\/li><\/ol>
        • if the customer selected an incorrect document type when placing the order,<\/li>
        • if the customer specified an incorrect number of pages when placing the order,<\/li>
        • if the document provided by the customer contains content punishable under German law, or<\/li>
        • if the order cannot be processed temporarily or permanently due to technical circumstances, translator illness, or other reasons.<\/li><\/ul>
          In the event of a cancellation by MyBeglaubigung.de, a withdrawal from the contract will occur, and the customer's payment will be refunded in full without any deduction of fees. The refund will be made exclusively via the payment method chosen during the order.<\/span><\/div>

          \u00a0<\/b><\/p>

          \u00a7 4 Retention of Title<\/b><\/p>

          \u00a0<\/span><\/div>
          If the payment method selected by the customer during the order subsequently fails, the delivered certified translations shall remain the property of MyBeglaubigung.de until full subsequent payment has been made.\u00a0<\/span><\/div>
          \u00a0<\/div>

          \u00a7 5 Methods of Payment<\/b>\u00a0<\/b><\/p>

          \u00a0<\/div>
          1. The customer can place the order according to \u00a7 2 paragraph 2 by paying with a credit card, PayPal, Apple Pay, Google Pay, Giropay, or Klarna.<\/li>
          2. Payment is mandatory for the order and thus for the order to take effect.<\/li><\/ol>

            \u00a7 6 Prices and Shipping Costs<\/b>\u00a0<\/b><\/p>

            \u00a0<\/div>
            1. All prices listed on the MyBeglaubigung.de website include the applicable statutory VAT, currently at 19.0%.<\/span><\/li>
            2. The postal delivery of certified translations is free of charge.<\/span><\/li>
            3. Falls the postal delivery fails or the shipment is lost, MyBeglaubigung.de will also bear the costs for a new postal delivery. This regulation applies as long as the reason for the failed postal delivery is not the responsibility of the customer, such as providing an incorrect or erroneous address (see \u00a7 3 paragraph 4).<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

              MyBeglaubigung.de is liable for any defects in accordance with the applicable statutory provisions, in particular \u00a7\u00a7 634 ff. of the German Civil Code (BGB).<\/div>

              \u00a0<\/b><\/p>

              \u00a7 8 Liability<\/b><\/p>

              \u00a0<\/div>
              1. Customer claims for damages are generally excluded. However, this does not apply to customer claims for damages resulting from injury to life, body, health, or essential contractual obligations (so-called cardinal obligations). Also excluded is liability for other damages based on an intentional or grossly negligent breach of duty by MyBeglaubigung.de, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.<\/li>
              2. MyBeglaubigung.de is liable for any violations of essential contractual obligations only up to twice the order value of the customer's order. Any compensation exceeding this amount must be determined and ordered by a court. However, this does not apply to customer claims for damages due to injuries to life, body, or health.<\/li>
              3. The limitations according to paragraphs 1 and 2 also extend to the legal representatives and vicarious agents of MyBeglaubigung.de if claims are made directly against them.<\/span><\/li><\/ol>

                However, according to \u00a7 2 Abs. 4, you have stated that we should begin the execution of the contract immediately, i.e., during the withdrawal period.                 1. This contract and all resulting rights and obligations are subject exclusively to the law and legislation of the Federal Republic of Germany. The application of the UN Sales Convention is excluded.<\/span><\/li>
                2. If the customer is not a consumer within the meaning of \u00a7 13 BGB, Berlin is agreed as the place of jurisdiction for all disputes arising from this contract.<\/li>
                3. MyBeglaubigung.de neither participates in dispute resolution procedures before consumer arbitration boards nor is obligated to do so.<\/li><\/ol>

                  \u00a7 11 Severability Clause<\/b>\u00a0<\/b><\/p>

                  If individual provisions of this contract are or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a regulation shall apply that comes closest to the economic purpose of the invalid or unenforceable provision.
